These Terms of Service govern your access to and use of www.ake53.com and any purchase you make through it. The website is owned and operated by Al Kaukaban Enterprises LLC, trading as AKE53, a limited liability company registered in Dubai, United Arab Emirates under trade licence number 206493.

By browsing this website, creating an account or placing an order, you confirm that you have read, understood and agreed to be bound by these Terms of Service, together with our Shipping Policy, Return and Refund Policy, Privacy Policy and Billing Policy, each of which forms part of these terms. If you do not agree with any part of these terms, please do not use this website.

1. Definitions

• We, us, our, the Company, AKE53 means Al Kaukaban Enterprises LLC, trading as AKE53.
• You, your, the Customer means the person browsing this website or placing an order through it.
• Website means www.ake53.com and all of its pages, content and functionality.
• Products means the goods offered for sale on the Website.
• Order means a request submitted by you to purchase Products through the Website.
• Business day means Monday to Saturday, excluding Sundays and UAE public holidays.

2. Eligibility to Use This Website

• You must be at least 18 years of age to place an order on this Website.
• You must have the legal capacity to enter into a binding contract.
• You must provide accurate, current and complete information when placing an order or creating an account.
• You must not use this Website for any unlawful purpose, or in any way that could damage, disable or impair it.
• Where you are purchasing on behalf of a business, you confirm that you are authorised to bind that business to these terms.

3. Your Account

You may create a customer account to make ordering easier. If you do:

• You are responsible for keeping your login details confidential.
• You are responsible for all activity that takes place under your account.
• You must notify us immediately at sales@ake53.com if you believe your account has been accessed without your permission.
• We may suspend or close an account that we reasonably believe has been used fraudulently, unlawfully or in breach of these terms.

4. Products, Descriptions and Availability

We supply locks, hand tools and general hardware. Our Products are sourced from established manufacturers in China, Italy and the United Kingdom.

• We take care to describe our Products accurately, including specifications, dimensions, materials and included accessories.
• Product images are provided for illustration. Colour reproduction varies between screens, and minor variations in finish or packaging may occur between production batches.
• Where a specification is critical to your application, please contact us at sales@ake53.com to confirm it before ordering.
• All Products are subject to availability. Listing a Product on the Website is not a guarantee that it is in stock at the moment you place your order.
• We reserve the right to add, withdraw or modify Products, and to limit the quantity of any Product available to a single customer, without prior notice.

5. Pricing and Currency

• All prices are displayed on the Product page and are confirmed at checkout before payment.
• Prices shown on the Website are exclusive of taxes. Applicable taxes are calculated and displayed separately at checkout before you confirm your order.
• Prices are exclusive of shipping charges, which are calculated at checkout based on your delivery address and the shipping method you select.
• Prices are exclusive of any customs duties or import charges that may be levied by the destination country. These are payable by the customer as set out in our Shipping Policy.
• The currency displayed on the Website may vary according to your location. The currency in which you will be charged is confirmed at checkout before payment.
• The price shown at checkout is the price you pay. There are no hidden fees added after your order is confirmed.
• We reserve the right to change prices at any time. A price change does not affect an order that has already been accepted and paid for.

6. Pricing Errors

Despite our best efforts, a Product may occasionally be listed at an incorrect price due to a typographical or system error. Where we identify a pricing error on an order you have placed, we will contact you before dispatch, explain the error and give you the choice of confirming the order at the correct price or cancelling it. We will never charge you more than the price you agreed without your express confirmation.

7. Orders and Order Acceptance

• Submitting an order through the Website is an offer to purchase, not a completed contract of sale.
• You will receive an order confirmation email acknowledging receipt of your order. This acknowledgement does not constitute acceptance.
• A contract of sale is formed only when we dispatch your order and issue a shipping confirmation.
• We reserve the right to refuse, cancel, hold or review any order. Reasons include the Product being out of stock, a pricing or listing error, suspected fraudulent activity, an inability to verify the payment or delivery details supplied, or a legal or export restriction affecting the delivery destination.
• Where we cancel an order, we will notify you promptly and will not charge you for the cancelled Products.

8. Order Cancellation and Modification

• Orders cannot be modified or cancelled by the customer once they have been placed and paid for.
• The delivery address on an order may be changed before dispatch. See our Shipping Policy for how to request this.
• There are no customer cancellation fees, as customer-initiated cancellation is not available after an order is placed.
• We reserve the right to cancel, hold or review any order that we reasonably suspect to be fraudulent, and to request additional verification before dispatch.

9. Payment

We accept payment by Visa, Mastercard, PayPal, Apple Pay and bank transfer. Full details of how payment is taken, how taxes are applied and how billing issues are handled are set out in our Billing Policy. Orders are not dispatched until payment has been received and cleared in full.

10. Shipping and Delivery

Shipping methods, dispatch timelines, delivery estimates, shipping charges, carriers, tracking and delivery problem resolution are governed by our Shipping Policy, which forms part of these terms. Delivery estimates are provided in good faith and are not guaranteed delivery dates. Risk in the Products passes to you on delivery.

11. Returns, Refunds and Exchanges

Returns, refunds and exchanges are governed by our Return and Refund Policy, which forms part of these terms. Please note in particular that products containing an electronic chip board, including digital and electric locks, and all digital products, are not returnable, and that approved refunds are issued as store credit. These provisions do not affect your statutory rights in respect of Products that are defective, damaged on arrival or not as described.

12. Promotions, Discount Codes and Offers

• Promotional offers and discount codes are limited to one use per customer unless the offer states otherwise.
• Discount codes have no cash value and cannot be exchanged for cash or store credit.
• Unless stated otherwise, discount codes cannot be combined with any other offer, code or promotion.
• Discount codes must be applied at checkout. We are unable to apply a code retrospectively to a completed order.
• We reserve the right to withdraw, amend or cancel a promotion at any time, and to cancel any order where a discount code has been obtained or used improperly.
• All promotions and offers advertised by AKE53 represent genuine savings. We do not use artificial countdown timers, false scarcity messaging or inflated reference prices.

13. Warranties and Disclaimers

AKE53 does not offer a separate product warranty or guarantee beyond the remedies set out in our Return and Refund Policy and your statutory rights under applicable law. Certain Products may carry a manufacturer warranty issued by the producer of that item, and where one applies the details are supplied with the Product.

To the fullest extent permitted by law, the Website and its content are provided on an as is and as available basis. We do not warrant that the Website will be uninterrupted, error free or free of harmful components, or that any defect will be corrected immediately.

We make no claims about medical, health or safety outcomes, and we do not guarantee any specific result from the use of our Products. It is the customer's responsibility to ensure that a Product is suitable for their intended application, and to install and use it in accordance with the manufacturer's instructions and any applicable safety regulations.

14. Limitation of Liability

To the maximum extent permitted by the laws of the United Arab Emirates, our total liability to you in connection with any order shall not exceed the total amount you paid for that order.

We shall not be liable for indirect, incidental, special or consequential loss, including loss of profit, loss of business, loss of contracts, loss of anticipated savings or loss of data, arising from the use of the Website or the Products.

Nothing in these terms excludes or limits our liability where liability cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.

15. Indemnity

You agree to indemnify and hold harmless Al Kaukaban Enterprises LLC, its owners, employees and agents from any claim, loss, liability or expense arising out of your breach of these Terms of Service, your misuse of the Website, or your violation of any law or the rights of a third party.

All content on this Website, including the AKE53 name, logo, text, product descriptions, photographs, graphics, page layout and design, is owned by or licensed to Al Kaukaban Enterprises LLC and is protected by applicable intellectual property law.

You may view and print content from this Website for your own personal or internal business use. These Terms of Service and any dispute arising out of or in connection with them, your use of this Website or any order placed through it, shall be governed by and construed in accordance with the laws of the United Arab Emirates as applied in the Emirate of Dubai.
